The Constitutional Court is expected to make a ruling in the battle between Public Protector Busisiwe Mkhwebane and President Cyril Ramaphosa on Thursday.
The case relates to the funding of President Ramaphosa’s campaign for leadership of the African National Congress in 2017, (CR17).
Ramaphosa, maintained that the public protector had no jurisdiction to investigate the donations made to his successful bid for the ANC presidency.
In her report, Mkhwebane found Ramaphosa had deliberately misled parliament when he answered a question from the Democratic Alliance’s then-leader Mmusi Maimane about a R500 000 campaign donation from Bosasa’s Gavin Watson.
The apex court will rule whether the president misled Parliament on the donations made to the CR17 campaign.
It will also decide if the public protector has the scope to investigate the campaign for ANC leadership by Ramaphosa.
